Terms of Service

1. Acceptance of Terms

By accessing this website or engaging the services of Fanatech Enterprise Solutions Ltd ("Fanatech", "we", "us", or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you ("Client" or "you") and Fanatech Enterprise Solutions Ltd, a company registered in Kenya.

2. Our Services

Fanatech provides enterprise security systems, ICT infrastructure, and technology integration services including, but not limited to:

  • CCTV surveillance design, supply, and installation
  • Access control and biometric systems
  • Electric fencing and perimeter security
  • Structured cabling and fibre optic networks
  • Fire alarm detection and suppression systems
  • IP PBX / PABX telephony systems
  • UPS and power backup solutions
  • Custom software development and system integration
  • Managed ICT and IT outsourcing services

The specific scope, deliverables, timelines, and pricing for any engagement are defined in a separate written proposal or service agreement signed by both parties.

3. Quotations & Proposals

All quotations and proposals issued by Fanatech are valid for thirty (30) days from the date of issue unless otherwise stated in writing. A quotation does not constitute a binding contract until a formal service agreement or purchase order has been signed and an initial deposit received where applicable.

Fanatech reserves the right to revise quotations if site conditions, client requirements, or material costs change materially between the time of quoting and commencement of works.

4. Payment Terms

Unless otherwise agreed in writing, the following payment structure applies:

  • 50% deposit — due upon acceptance of the quotation and before procurement of materials or commencement of works.
  • 40% progress payment — due upon substantial completion or at an agreed milestone.
  • 10% final payment — due upon project handover and client sign-off.

Invoices are payable within fourteen (14) days of the invoice date unless otherwise specified. Fanatech reserves the right to charge interest at 2% per month on overdue balances and to suspend services for non-payment.

All prices are in Kenya Shillings (KES) and exclude VAT unless otherwise stated.

5. Client Obligations

To enable Fanatech to deliver services effectively, the Client agrees to:

  • Provide accurate and complete information about site conditions, requirements, and existing infrastructure.
  • Ensure safe and reasonable access to the premises during agreed working hours.
  • Designate a point of contact authorised to make decisions on the project.
  • Review and approve deliverables in a timely manner to avoid project delays.
  • Ensure that all necessary consents, permits, or landlord approvals are obtained prior to works commencing.

6. Warranty & Support

Fanatech warrants all installed hardware and workmanship for a period of twelve (12) months from the date of project handover, unless a longer warranty period is specified in the service agreement. This warranty covers defects in materials supplied and installation workmanship.

The warranty does not cover:

  • Damage caused by misuse, tampering, or unauthorised modifications.
  • Consumable items such as batteries, ink, or print media.
  • Damage caused by power surges, lightning, flooding, or other acts of nature.
  • Third-party software or hardware not supplied by Fanatech.

After-warranty support and maintenance contracts are available and can be arranged separately.

7. Intellectual Property

All content on this website — including text, graphics, logos, and software — is the property of Fanatech Enterprise Solutions Ltd and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this website without our prior written consent.

Custom software, dashboards, or digital tools developed by Fanatech for a client remain the intellectual property of Fanatech unless a specific written agreement transfers ownership to the client.

8. Confidentiality

Both parties agree to treat as confidential any proprietary or sensitive information exchanged in the course of an engagement. Fanatech will not disclose client site plans, system configurations, or security details to third parties except as required to deliver the contracted services or by law.

9. Limitation of Liability

To the maximum extent permitted by Kenyan law, Fanatech's total liability for any claim arising from the provision of services shall not exceed the total fees paid by the Client for the specific project giving rise to the claim.

Fanatech shall not be liable for indirect, incidental, or consequential damages including loss of profit, loss of data, or business interruption, even if advised of the possibility of such damages.

Fanatech is not liable for losses arising from the Client's failure to maintain, update, or use installed systems in accordance with manufacturer guidelines.

10. Termination

Either party may terminate an engagement by giving thirty (30) days' written notice. In the event of termination, the Client shall pay for all work completed and materials procured up to the date of termination. Deposits are non-refundable once procurement or installation has commenced.

11. Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from or related to these Terms or any service engagement shall first be referred to good-faith negotiation between the parties. If unresolved within thirty (30) days, disputes shall be submitted to binding arbitration in Nairobi under the Arbitration Act, Cap 49 of the Laws of Kenya.

12. Changes to These Terms

Fanatech reserves the right to update these Terms of Service at any time. Changes will be posted on this page with a revised date. Your continued use of our website or services after any changes constitutes acceptance of the updated terms.
